Aiming to break with the procedural culture paradigm that was
consolidated under the perspective of the inquisitive model, this study
brings up practical and theoretical discussions surrounding the institute
of the guarantees judge disciplined in Law nº 13.964/2019. Being the
exclusive responsible for judicial action in the preliminary investigation
stage and having the primary purpose of ensure the legality of
investigations, the new regulation, which streamlines the investigative
activity, is in realizing the fundamental rights of the criminally accused.
Empowered in this context and considering that the implementation of
the judge of guarantees will cause the remodeling of jurisdictional
powers in the states, this research presents a quantitative and qualitative
approach to official data, re-signified and problematized according to
an empirical approach. Therefore, the study aims to provide, through
the inductive method, a parameter to measure the effects on the criminal
judicial units of the Judicial District of Natal-RN, Brazil.
