EXPANSÃO PUNITIVISTA, CULPABILIDADE E IMPUTAÇÃO PENAL EMPRESARIAL

Abstract

The present work seeks to analyze the problematic of the criminal policy of combating crime taking as its object the analysis of the company's culpability as a legal entity. In other words, if within the doctrinal and jurisprudential perspective there is the possibility of attributing to a legal entity acts of its own whose consequence is autonomous to human action and that this action or omission entails a degree of guilt inherent and belonging to the sphere of Criminal Law, analyzing criteria related to the so-called expansion of criminal law, the objective imputation and the application of the penalty itself and its purpose.
