WITTGENSTEIN E A PRÁTICA CLÍNICA NA EXECUÇÃO PENAL: UMA POSSÍVEL CONTRIBUIÇÃO DA FILOSOFIA DA LINGUAGEM PARA AS CIÊNCIAS CRIMINAIS

Abstract

Clinical practice in criminal execution is one of the central objects of criminological criticism since the transition from the etiological paradigm to that of social reaction, occupying a large space of tension between the criminal justice system and the studies on crime and violence. In Brazil, the performance of criminological examinations with the aim of verify the "ability to the return to society" is the most controversial practice in the execution phase, receiving criticisms of several orders. In order to promote a philosophical analysis about the question, this article used the linguistic assumptions of Ludwig Wittgenstein to identify, through bibliographic research, the possible inconsistencies caused by language in these personality exams. It was possible to conclude that the so-called "pathologies of language" may be responsible for stereotypes implicit in technical assessments, which is why the conclusions found should not be taken as the maximum expression of truth.
