This paper purpose to understand the elements that had been taken) central of the legal debate of the Arguição de Descumprimento de Preceito Fundamental (ADPF) 132 analyzed with the Ação Direta de Inconstitucionalidade (ADI) 4277 by the Federal Supreme Court. In the debate, wicht was intended to verify in if there was incidence on the request for recognition of equivalence between "homoaffective unions" and stable unions. So, it was a subject to analysis over Articles 226 of the Constitution and the 1723 Civil Code, which was reckoned as a stable family formation. Through the analysis of the speeches made by the different present groups, antagonistic in their goals and representations, we can highlight the way in which moral and religious values can be present, although it’s represent a subject of the public character. The association between family and homosexuality seems, therefore, to continue entangled by religious-social control. It matters, thus, to recognize how this control has been made.
