Este artigo investiga, a partir das teses de Kant e de Kelsen, as consequências, no âmbito da filosofia política e do direito, da aceitação e da negação da metafísica na fundamentação da moral e do direito. Tendo em vista a influência do pensamento kantiano em Kelsen, na primeira seção apresenta-se a relação entre direito e moral em Kant; na segunda seção mostra-se como se estabelece a relação entre direito e moral em Kelsen e, por fim, na terceira seção realiza-se uma avaliação de ambas as propostas e de seus reflexos na política.
