Artificial Intelligence Policy

The journal *Constituição e Garantia de Direitos* closely follows the ongoing development of Artificial Intelligence (AI) technologies and their impact on scientific research, and is committed to periodically reviewing and updating this policy, including with regard to methods for detecting any unethical conduct associated with their use. Based on the standards established by the Committee on Publication Ethics (COPE), as well as guidelines widely recognized by indexers such as the Directory of Open Access Journals (DOAJ), it determines:

For purposes of authorship, only creations of the human mind are considered as such, with intellectual, ethical, and legal responsibility for submitted works attributed exclusively to natural persons. Artificial Intelligence tools, including language models based on machine learning techniques (Large Language Models – LLMs), such as ChatGPT, do not meet the criteria for authorship and cannot be listed as authors or co-authors of manuscripts.

The use of AI tools as an aid to scientific production is permitted, particularly for the purposes of checking grammar, spelling, and style, as well as for translation, and to assist with text organization and data analysis, provided that such uses do not involve the autonomous generation of original scientific content. The use of AI for the substantial drafting of the text, for the creation of arguments, results, or conclusions without human supervision, or for the fabrication of nonexistent data, references, or citations is not permitted.

Authors must transparently disclose the use of AI tools via a form attached to the submission documents and through a clear description in the work's methodology section, specifying the tool used, the purpose of its use, and the extent of its intervention in the text. Failure to provide this declaration may be considered a violation of the Journal's ethical guidelines.

Any ethical violations related to the misuse of Artificial Intelligence may result in the adoption of editorial measures commensurate with the severity of the violation, including rejection of the manuscript, retraction of a published article, temporary suspension of new submissions, and notification to the authors’ affiliated institutions, in accordance with the journal’s editorial policies.

In the context of peer review, the Journal Constituição e Garantia de Direitos does not recommend the use of generative AI tools, given their limitations regarding the reliability of information and the risks to the confidentiality of manuscripts. Reviewers must refrain from entering texts, in whole or in part, into such tools, thereby preserving the confidential nature of the review process. In the event of exceptional use of AI as an auxiliary tool, this must be expressly stated and justified in the review.

Through this policy, the Journal reaffirms its commitment to scientific integrity, editorial transparency, and the responsible use of emerging technologies in the field of legal research.
