The possibilities of rights regression in the American Convention of Human Rights

Abstract

The present article intends to analyze the legal regime composed of the set of rules contained in the text of the American Convention on Human Rights, that limit and conform the possibility of limitations to the rights it provides for. For this, it was adopted an inductive method, based on a literature review on the topic, in addition to the analysis and study of the conventional text. It was noticed, throughout the work, that the Convention foresees a regime of restriction to the limits of human rights, directing the provisions of the States in this sense and, thus, qualifying the content of the list of rights and the relationship between species and, also, protecting this role and the core of central values that guide the inter-american human rights system, which its right set seek to achieve.
