Application of international court judgments in Brazil

This academic article aims to analyze the current, or lack thereof, system for applying judicial sentences from international courts in the Brazilian State. The need for a detailed legal analysis of the internal mechanisms of the national legal system aimed at ensuring the effectiveness of international decisions became more pressing following the condemnation of the Brazilian State by the Inter-American Court of Human Rights (IACHR) in the Ximenes Lopes case in 2007. The objective is, therefore, to ascertain the existence of dispositive legislative and constitutional regulations regarding the execution of international judgments as a whole, in contrast to the international obligations assumed by Brazil, as well as in dissonance with established constitutional principles.
