economic analysis, science and ethics in Cláudio Souto
Abstract
Starting from the conceptualization of Legal Dogmatics as a system of forms of coercibility (Cláudio Souto), this work delves into its relationship with the scientific knowledge of other social sciences, as well as with its meta-scientific aspects. In this way, the strictly methodological character of the economic analysis of law (EAL) and the presence of inherent ethical aspects in legal inquiry are highlighted, implying alterations in the conceptualization of efficiency applicable to law, in order to legitimize the hermeneutical reading of efficiency in a legal sense, and not in an economic sense. Finally, this result is applicable to public policies and the legitimation of regulatory processes (Luhmann), in the search for a theoretical configuration of the principle of seriousness or sincerity in public spending, which is still little studied in Brazil.
