Effects of a bankruptcy ruling on the debtor's lease agreements (shopping centers)

The purpose of this article is to study the effects of a bankruptcy judgment against the debtor on lease agreements (shopping centers). From this perspective, the article seeks to examine the contractual relationship between the landlord and the tenant under the framework of the reorganization and bankruptcy law, highlighting, among other aspects, the rights and obligations of each party. Finally, after examining the legal treatment of the subject, the article discusses the non-termination of contracts due to bankruptcy and the possibility of contract performance by the bankruptcy trustee if such action reduces or prevents an increase in the liabilities of the bankruptcy estate or is necessary for the maintenance and preservation of its assets.
