WOMEN'S POLITICAL PARTICIPATION IN THE CHILEAN CONSTITUTION

Abstract

This study focuses on issues of justice, constitutionalism and political participation, analyzing the policy of equal participation in the composition of the Chilean Constituent Assembly, while comparing the social and political contexts of the Brazilian state, especially with regard to the political participation of women, from the perspective of the three-dimensional model of social justice proposed by Nancy Fraser, based on recognition, redistribution and representation, starting from the hypothesis that the pro-gender equality measure manifested by the Chilean Constituent Assembly represents the state's commitment to promoting gender parity, denouncing the exclusionary models in both countries, manifested by informal impediments. To this end, the research will use the interpretative method of constitutional comparison, especially with regard to women's political participation in Chile and Brazil, delving into Fraser's three scales of justice (recognition, redistribution and representation) in order to differentiate the social, economic and political contexts of both countries, attesting to the urgent need to overcome the informal impediments imposed on women. The article concludes that the three-dimensional model of social justice presented by Nancy Fraser, based on recognition (who), redistribution (what) and representation (how), proposes the principle of parity of participation as an emancipatory ideal, which to some extent is present, unlike Brazil, in the adoption of the policy of parity of participation in the composition of the Chilean Constituent Assembly, thus representing an important advance in the country's process of re-democratization.
