The objective of this article is to discuss whether there is compatibility between the nature of legality and the instrument of constitutional review provided for in Article 102, §2 of the Brazilian Federal Constitution and regulated by Law 9.868 of 1999, called the "declaratory action of constitutionality." The methodology employed was the analysis of conceptual constructions originating from the analytical philosophy of law, specifically the notions of "authority as service" and "protected reasons" defended by Joseph Raz, as well as the planning theory of law supported by Scott J. Shapiro based on the concept of "circumstances of legality." The usefulness of deepening the debate on these concepts and the practical consequences of accepting such perspectives are also explained. It is concluded that the aforementioned institute is conceptually incompatible with the nature of legal norms.
