NOTES ON THE DECISION OF THE BRAZILIAN SUPREME COURT IN GOVERNOR OF THE STATE OF RORAIMA V. STATE UNVERSITY OF RORAIMA

This article analyzes the interpretative contours of the constitutional rules that regulate the financial and budgetary autonomy of universities, in light of the recent decision handed down by the Brazilian Supreme Court in ADI 5946. In this case, which originated in the State of Roraima, the goals for interpretations about the models of university autonomy were listed, declaring the rules of the Constitution of the State of Roraima partially unconstitutional. The approach, in addition to dealing with the conceptualization of pluricentric administration, seeks to analyze the financial transfers called “twelfths” (duodécimos in Portuguese) as an essential prerogative to university financial autonomy, and then to point out the wrong reasoning carried out by the winning decision in Governor of the State of Roraima v. State University of Roraima.
