The oversight and implementation of the right to health

This study aims to examine the oversight and implementation of the right to health by the South African judiciary, particularly the country's Constitutional Court. To this end, a brief overview of the historical context of South Africa's new democracy and the structure of the judicial system that accompanied it will be provided. The South African judicial system will be outlined to facilitate a better understanding of the cases examined, and, finally, the Constitutional Court's jurisprudence regarding the fundamental right to health and related matters will be analyzed.
