The present study aims to understand the constitutional principles from the perspective of implementing the Democratic Rule of Law within the scope of the Brazilian State. Initially, the history of the Brazilian State is studied, from Empire Brazil to the current State, passing through republics and dictatorships. Secondarily, the principles present in the 1988 Federal Constitution are analyzed in order to understand them. Finally, the conclusion is that the principles are one of the most effective ways of implementing the Democratic Rule of Law. To carry out the research, the deductive method was used, with a qualitative nature, and with bibliographic and historical research (using as sources: books, scientific articles, case law and others).
