Brief reflection on the construction of the idea of social protection and the right to health in the 1988 Federal Constitution

This article aims to carry out an initial analysis of the process of formulating the idea of the right to health as a social right, part of the list of fundamental rights enshrined in the 1988 Federal Constitution. To this end, a brief historical foray into the process of constructing the concept of social protection in the world is carried out. The aim is also to analyze social protection as a fundamental factor of citizenship, social security as the core of the Welfare State and discuss the context of insertion of the issue of the right to health on the public agenda. The present work uses the analytical method, through the appropriation of the concepts of social protection and social rights, seeking to reflect on the determinations of the contents present in the conception of the right to health.
