A reinterpretation of hobbesian thought on the Right to Self-Preservation

This article reflects on the importance of the philosophy of law in understanding the world and in the development of legal science. In this context, based on Hobbes's doctrine, the possibility of coexistence between the sovereign state defended in Leviathan and the individual's right to self-defense will be addressed. Finally, answers will be presented, in light of Hobbes's doctrine, to a real and social problem, represented on the one hand by the sovereignty of state law and, on the other, by the individual's right in society, focusing on the obligation of subjects to obey the order emanating from the sovereign only as long as the sovereign is able to protect them.
