Abstract

The present study aims to analysis the (in)constitutionality of the 156 article, inc. II, of the Penal Process Code, based on the guidelines of the Acusatory Sistem inserted in our legal sistem by the 1988’s Federal Constitution debating the role of criminal judje in the instruction, in the Democratic State of Law, and the aspects of determination, during the judicial process of criminal proceedings, the execution of steps to solve any doubts regarding relevant points, confronting founding principles and rulers of the Brazilian criminal process.
