The FUNDAMENTAL RIGHT OF PERSONALITY IN THE DIGITAL AGE IN THE LIGHT OF THE FEDERAL CONSTITUTION AND THE GENERAL DATA PROTECTION LAW

Technological progress has substantially impacted the way people communicate, commercial and market relationships as well as interpersonal relationships in general. In this new scenario, the personal data of individuals have become precious assets of the so-called digital economy, which develops based on data flows. Such circumstances generated the global need to create regulations in order to demand from institutions the commitment to individuals, holders of data that move contemporary society. In Brazil, in order to protect these rights, Law 13,709/2018, known as the General Data Protection Law (Lei Geral de Proteção de Dados - LGPD), was enacted. In this bias, this article aimed to verify what are and how are the Fundamental Rights of Personality protected in the LGPD. The methodology used in this work is qualitative in terms of approach and, in terms of procedure, it was based on bibliographic analyzes whose and documental research, especially the Brazilian Constitutional Legal Order and the LGPD.
