Transsexualism and the right to identity through the possibility of altering civil registration in light of Resolution No. 1.955/2010 of the Federal Council of Medicine (CRFM)

Abstract

The current Brazilian Federal Constitution mandates dignified and equal treatment that allows the free and conscious exercise of rights. Therefore, this work addresses "Transsexualism and the Right to Identity Through the Possibility of Altering Civil Registration in Light of Resolution No. 1.955/2010 of the Federal Council of Medicine (CRFM)," primarily aiming to analyze the current situation of transsexuals in society, in light of the principle of equality and the dignity of the human person, focusing on the right to identity, with the possibility of altering civil registration. As established by CRFM/2010, a transsexual is considered to have a permanent psychological deviation of sexual identity, with a tendency towards self-mutilation and/or suicide, a pathology registered in the International Classification of Diseases (ICD) under code F64.0. Given this, the study specifically sought to analyze the pathological nature of transsexualism, relating it to the importance of the Civil Registry, as well as the legal grounds for its alteration. It also aimed to identify the specific conditions for altering the civil registry, identifying the current position regarding the alteration of the civil registry of transsexuals. To this end, a bibliographic research was conducted, employing a qualitative approach at an explanatory level, through case studies, testimonies, and field research with support groups for transsexuals and the Sexual Diversity Commission of the Brazilian Bar Association (OAB), based in Teresina-PI. A considerable advance was observed in Teresina society and the judiciary, which, according to the research results, are favorable to the recognition of the identity of transsexuals.
