Considerations on the economic analysis of law and effectiveness
the fundamental right to health in Brazil

This article aims to analyze the means to guarantee the effectiveness of the fundamental right to health in the Brazilian Democratic State of Law. How are social rights related to health realized according to current constitutional values? More than merely limiting political power, constitutionalism guarantees an axiological aspect to rights, conferring material fundamentality upon them and having as its primary guiding principle the dignity of the human person. This study also focuses on the details of the right to health. What are its essential characteristics of structure and operation? The creation of the Unified Health System (SUS) favored the implementation of an egalitarian, non-contributory, and universally accessible health system. This audacious task requires a series of normative, judicial, and extrajudicial instruments to be accomplished. Ensuring the effectiveness of this right requires positive actions from the State and the consequent implementation of the necessary public policies; however, there are some limitations, most notably budgetary ones, which must be evaluated. The social and economic cost of these demands, as well as the possibility of applying cooperative and judicial solutions, are key points for meeting the needs of the beneficiaries of the health system. Economic Analysis of Law also serves as a foundation for seeking the realization and effectiveness of this right.
