REVISITING THE CONCEPT OF ENLIGHTENMENT PROGRAM

A WAY TO OVERCOME THE OPPOSITION BETWEEN CIVIL CODE AND CONSUMER PROTECTION CODE

Abstract

The text analyzes the rationalit project of Civil Code and its counterpoint with the model of the Consumer Protection Code. It maintains that, despite the marked differences, there are permanences, especially from the perspective of the Enlightenment program. It discusses the specification of the subject, problematizes common places about the constitucionalization of civil law and situates aspects of vulnerability. To do this, it uses the notion of life on credit and contextualizes in the Brazilian scenario. Finally, it points to the illusory nature of modern narratives, which includes the Code.
