REAÇÕES CONSERVADORAS AO RECONHECIMENTO JUDICIAL DO DIREITO DE UNIÃO ENTRE PESSOAS DO MESMO SEXO NO BRASIL E NA COLÔMBIA

Abstract

Taking under consideration that backlash can be defined as a range of political and juridical efforts made by sectors of society that are opposed to decisions against their interests, this article aims to analyze the social and political reaction arising from  the decisions of the Constitutional Court of Colombia and the Supreme Court of Brazil that have recognized the homo-affective unions. Therefore, it is concluded that in Brazil and Colombia the conservatory forces are opposed to the ruling of the Courts, hindering the recognition of rights of the LGBTI. However, there was no legislative success able to alter those binding precedents.
