A COOPERAÇÃO PENAL INTERNACIONAL NO PROJETO DE REFORMA DO CÓDIGO DE PROCESSO PENAL BRASILEIRO

The legal system in Brazil is based on the Carta Maior, which promotes the effectiveness of the State as a democratic country, based on the implementation of fundamental guarantees. In this context, a study is proposed on international criminal cooperation, through which a State requests administrative or judicial measures from another nation to instruct a procedure within its jurisdiction, focusing on sharing evidence and respect for constitutional and legal norms. infraconstitutional provisions in force in Brazil. The problem faced is related to the need for more effective legislative changes with regard to international criminal cooperation, so that the issue of probative production with respect to the constitutional guarantees owed to the defendant becomes a reality. This study was divided into 3 topics, which will deal with the relevant aspects of International Criminal Cooperation, followed by the traditional methods used in this institute and, finally, on how this issue is addressed in the project to reform the Code of Criminal Procedure now in discussion.
