THE RIGHT TO LAND AS A JUSTRANSITIONAL AXIS

The aim of this paper is to take a look at the Brazilian justransitional process, especially from the point of view of the recommendations of the National Truth Commission for indigenous peoples. It also seeks, from the perspective of post-colonial theories, to identify the socio-legal-economic parameters that emerge as resistance to the justransitional process in Brazil. Particularly for native peoples, it defends the need for a justransitional process oriented towards the specificities of these peoples, placing the territorial element as the center of gravity for the debate.
